1. Agreement to Terms

By accessing or using aiStudyBuddy.academy ("Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

For users under 18 years of age, a parent or legal guardian must review and agree to these Terms on behalf of the minor.

2. Description of Service

aiStudyBuddy.academy is an AI-powered online tutoring platform designed for grades 4-12 students. Our Service provides:

• One-on-one AI tutoring sessions personalized to student grade level and learning needs
• Support for various subjects including math, science, reading, and more
• Session history tracking and progress reports for parents
• File upload capabilities for homework assistance
• Assessment and feedback features

3. User Accounts and Eligibility

3.1 Parent/Guardian Accounts

You must be at least 18 years old to create an account. Parents or legal guardians create accounts and are responsible for:

• Creating student profiles for their children
• Monitoring student usage and session content
• Maintaining payment information
• Ensuring compliance with these Terms

3.2 Student Accounts

Student profiles are created and managed by parents/guardians. Students may not create accounts independently. We comply with the Children's Online Privacy Protection Act (COPPA) for users under 13 years of age.

3.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Pricing and Payments

4.1 Session Credits

Our Service operates on a pay-per-use model. You purchase session credits which are used when students engage in tutoring sessions. Current pricing includes:

• Free trial: 120 minutes of tutoring when credit card is added (no purchase required for trial)
• Additional session credits available for purchase
• Session credits do not expire

4.2 Payment Processing

All payments are processed securely through Stripe. You agree to provide current, complete, and accurate payment information. We do not store your complete credit card information on our servers.

4.3 Refunds

Unused session credits are generally non-refundable. However, we may provide refunds at our sole discretion on a case-by-case basis. To request a refund, contact us within 7 days of purchase.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Upload or share any content that is harmful, offensive, or violates others' rights
• Attempt to circumvent any security features or access restrictions
• Use the Service to cheat on exams or plagiarize assignments
• Share account credentials with unauthorized users
• Reverse engineer, decompile, or attempt to extract the source code of our AI models
• Use automated systems or bots to access the Service

6. Educational Purpose and AI Limitations

Our AI tutoring service is designed to supplement, not replace, traditional education. Important disclaimers:

• AI-generated responses may contain errors or inaccuracies
• The Service should be used as a learning aid, not as a substitute for human teachers
• We do not guarantee specific academic outcomes or improvements
• Parents/guardians should review session content and monitor student progress
• For critical academic matters, consult with qualified human educators

7. User Content

7.1 Content Ownership

You retain ownership of any content you upload to the Service (homework, documents, images, etc.). By uploading content, you grant us a limited license to process and display such content solely for the purpose of providing the Service.

7.2 Content Responsibility

You are solely responsible for the content you upload. We reserve the right to remove any content that violates these Terms or is otherwise objectionable.

8. Intellectual Property

The Service, including all content, features, and functionality, is owned by aiStudyBuddy.academy and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our Service without explicit written permission.

9. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to our collection and use of information as described in the Privacy Policy.

10. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms. You may also terminate your account at any time by contacting us.

Upon termination, your right to use the Service will immediately cease. Unused session credits may be forfeited upon account termination.

11. Disclaimers and Limitation of Liability

11.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AISTUDYBUDDY.ACADEMY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

11.3 Maximum Liability

In no event shall our total liability to you for all damages exceed the amount you paid us in the 12 months prior to the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless aiStudyBuddy.academy and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another party.

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in court for intellectual property disputes.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
